O.P. v S.R.
Landlord wins
- Dispute
- Breach of Conditions, Non-payment of Rent
- Landlord
- O., O.
- Tenant
- S., K.
What happened
Landlords applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent and meet conditions specified in a previous settlement. Tenants filed a motion to set aside the eviction order. The Board denied the motion to set aside but delayed lifting the stay on the eviction order.
The ruling
The Board denied the Tenants' motion to set aside the original eviction order due to their failure to provide evidence of ability to pay rent arrears. However, the Board delayed lifting the stay on the eviction order until May 22, 2017, giving Tenants two weeks to find alternative accommodation.
