What happened

Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent and persistent late payment of rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears.

The ruling

The tenancy is terminated unless the Tenant voids the order by paying $37,886 on or before October 31, 2022. If the order is not voided, the Tenant owes the Landlord $32,508.55 and must vacate the unit by November 10, 2022. If the Tenant voids the order, the tenancy will continue with the requirement to pay rent in full and on time for one year starting December 1, 2022.
