What happened
Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent and persistent late payment of rent. The Landlord also applied for an order requiring the Tenants to compensate the Landlord for damages to the premises.
The ruling
The Landlord's L1 application is dismissed. The Tenants shall pay the monthly rent in full and on time to the Landlord on the first day of each corresponding month for the period 1 September 2021 to 31 Aug 2022. If the Tenants fail to make any of the payments, the Landlord may apply for an order terminating the tenancy and evicting the Tenants, and for the payment of any new arrears of rent and NSF charges. The Tenants shall also pay to the Landlord $201.00 for the cost of filing the application. If the Tenant does not pay the Landlord the full amount owing on or before August 21, 2021, the Tenant will start to owe interest at 2.00% annually on the balance outstanding.
