What happened
Landlord applied for an order to terminate the tenancy and evict Tenants due to non-payment of rent. A valid N4 Notice was served, which Tenants did not void. Tenants were still in possession of the rental unit at the time of the hearing. A payment plan agreement was reached between the parties before the hearing.
The ruling
The Board ordered Tenants to pay $1,875.02 for rent arrears and costs in 6 monthly installments of $312.50 from November 15, 2022 to April 15, 2023. Tenants must also pay new rent on time from November 1, 2022 to April 1, 2023. If Tenants fail to make any payment, the Landlord may apply for termination and eviction within 30 days of the breach.
