What happened

Tenant applied for an order determining that the Landlord collected or retained money illegally. The Landlord served the Tenant with an N12 notice to terminate the tenancy for the Landlord's own use, but the notice was defective. The Tenant vacated the rental unit on March 31, 2020 pursuant to the N12 notice.

The ruling

The Landlord failed to pay the Tenant compensation for termination of the tenancy due to the Landlord's own use, as required by the Residential Tenancies Act, 2006. The Landlord is ordered to pay the Tenant $1,350.00 in compensation and $53.00 for the cost of filing the application, for a total of $1,403.00.
