What happened
Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears. The tenants had vacated the rental unit on September 8, 2022, prior to the hearing date.
The ruling
The tenancy is terminated effective October 24, 2020. The Tenants must pay the Landlord $3,776.92 in rent arrears and $175 in application fees, plus $14.30 per day in compensation for use of the unit from October 14, 2020 until they vacate. If the Tenants pay $4,201 by October 24, 2020, the eviction order will be void and they can remain in the unit.
