What happened

Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The Tenant raised issues under section 82 of the Residential Tenancies Act, 2006 claiming the Landlord breached his maintenance obligation and failed to maintain the unit in a good state of repair by refusing to repair/replace the broken stove and broken entry lock device.

The ruling

The review of the previous order is granted. The Tenant is ordered to pay the Landlord $6,816.61 in rent arrears according to a payment schedule, and to pay current and future rent on time. If the Tenant fails to make any of the required payments, the Landlord may apply to terminate the tenancy and evict the Tenant. The Landlord is ordered to pay the Tenant $774.19 for maintenance issues.
