What happened
Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The Tenant had vacated the rental unit on September 8, 2022, prior to the hearing date, but did not return the keys or formally give up possession.
The ruling
The tenancy is terminated unless the Tenant pays the outstanding rent arrears and costs by September 30, 2022 or October 31, 2022. If the Tenant does not pay, the Tenant must vacate the rental unit by October 31, 2022. The Tenant is entitled to a 20% rent abatement for the period the Tenant and their family did not feel safe living in the rental unit due to the broken garage door.
