What happened
Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenant did not void by paying the arrears. The tenant was not present at the hearing.
The ruling
The tenancy is terminated effective January 22, 2021. The tenant must pay the landlord $10,007.07, which includes rent arrears up to December 31, 2020 and the application filing fee, minus the $2,000 the tenant paid after the application was filed. The tenant must also pay $33.93 per day as compensation for occupying the rental unit from January 1, 2021 until the date they vacate. If the tenant does not pay the full amount by January 22, 2021, they will owe interest at a simple rate of 2% per year on the outstanding balance starting January 12, 2021. If the tenant does not vacate by January 22, 2021, the landlord can file the order with the Sheriff to have the tenant evicted.
