What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to persistent late payment of rent and non-payment of rent. The original order was issued on July 26, 2016, but the Tenant requested a review, alleging that there were no rent arrears at the time of the hearing because the money owing to the Landlord was for an unpaid water bill.

The ruling

The request to review order EAL-57548-16 issued on July 26, 2016 is granted. Order EAL-57548-16 is cancelled and replaced with a new order. The application to evict the Tenant for persistent late payment of rent and non-payment of rent is denied, subject to certain conditions.
