What happened

Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The Landlord served a valid N4 Notice, which the Tenants did not void by paying the arrears. The Tenants were still in possession of the rental unit at the time of the hearing but did not attend. The Landlord requested an order for arrears only, as there was a previous hearing that would result in termination of the tenancy on April 30, 2023.

The ruling

The Tenants are ordered to pay the Landlord $7,963.43, which includes rent arrears up to March 15, 2023, and the cost of filing the application, minus the rent deposit and interest on the deposit. Additionally, the Tenants must pay $56.56 per day for the use of the unit starting March 16, 2023, until they move out. If the full amount is not paid by April 30, 2023, interest will start accruing at 5% annually on the outstanding balance.
