What happened

Landlords applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice of Termination effective November 30, 2020, which the tenants did not void by paying the arrears.

The ruling

The tenancy is terminated effective August 15, 2021. The Tenants must pay the Landlords $35,000.00, which represents the rent arrears and compensation up to August 3, 2021, plus $95.34 per day for compensation for use of the unit starting August 4, 2021 until the Tenants move out. The Tenants must also pay the $186.00 application fee. If the Tenants do not pay the full amount by August 14, 2021, they will owe interest at 2% annually on the outstanding balance. If the unit is not vacated by August 14, 2021, the Landlords may file the order with the Court Enforcement Office for enforcement. The Tenants can void the order and continue the tenancy by paying $36,234.74 on or before August 14, 2021.
