What happened

Landlord applied for an order to terminate the tenancy and evict the Tenant because the Landlord has entered into an agreement of purchase and sale of the rental unit and the purchaser requires possession of the rental unit for the purpose of residential occupation. The Tenant did not vacate the rental unit on December 31, 2020 in accordance with the N12 notice given. However, the Landlord and the Tenant have subsequently signed an N11 form agreement to terminate the tenancy as of June 15, 2021.

The ruling

The tenancy between the Landlord and the Tenant is terminated as of June 15, 2021 based on the N11 form agreement to terminate the tenancy. The Tenant must move out of the rental unit on or before June 15, 2021. If the unit is not vacated by that date, the Landlord may file the order with the Court Enforcement Office (Sheriff) to enforce the eviction. The Tenant shall also pay the Landlord $60.82 per day for compensation for the use of the unit from June 16, 2021 to the date she moves out.
