What happened

Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice of Termination effective September 21, 2021, which the tenants did not void by paying the arrears.

The ruling

The tenancy is terminated effective February 6, 2022. The Tenants must move out by this date. The Landlord owes the Tenants $45.88 from the rent deposit and interest, but the Landlord can offset this amount with compensation for the Tenants' continued occupation and the application filing fee. If the Tenants pay $2,035.12 by January 31, 2022 or $3,736.48 by February 6, 2022, they can void the eviction order and continue the tenancy.
