What happened

Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent and persistent late payment of rent. The Landlord served a valid Notice of Termination for non-payment of rent, but the Tenants paid the full arrears before the hearing date. The Landlord also claimed the Tenants were persistently late in paying rent.

The ruling

The Landlord's L1 application for arrears was dismissed as the Tenants paid the full arrears before the hearing. However, the Landlord was granted a conditional order under Section 78 of the Act, requiring the Tenants to pay rent on time for the next 12 months. If the Tenants fail to make any one of the payments, the Landlord may apply for an order terminating the tenancy and evicting the Tenants. The Tenants were also ordered to pay the $201 application filing fee to the Landlord by October 30, 2021.
