What happened

Landlord applied for an order requiring Tenants to pay the rent they owed, as well as NSF cheque charges and related administration charges. The application was resolved by an order issued on November 15, 2021, but the Tenants requested a review of the order, alleging they were not reasonably able to participate in the hearing because they did not receive the Notice of Hearing.

The ruling

The Tenants' request for review is granted. The previous order is cancelled and replaced. The Tenants are ordered to pay the Landlord $2,163.50 in rent arrears and $201 for the cost of filing the application. If the Tenants do not pay the full amount by February 25, 2022, they will owe simple interest at 2% annually on the outstanding balance.
