What happened

Landlord applied for an order to terminate the tenancy and evict Tenants due to the Tenants transferring occupancy of the rental unit to several unauthorized occupants in a manner not authorized by the Residential Tenancies Act, 2006. The unauthorized occupants were in possession of the rental unit on the date the application was filed and had not paid any rent to the Landlord.

The ruling

The tenancy between the Landlord and the Tenants is terminated as of August 20, 2020. The unauthorized occupants shall move out of the rental unit on or before May 23, 2021 and pay the Landlord $9,653.70 for use of the unit from September 1, 2020 to May 12, 2021, as well as $37.81 per day from May 13, 2021 until they move out, and $201.00 for the cost of filing the application. If the full amount is not paid by May 23, 2021, the unauthorized occupants will owe interest at 2.00% on the outstanding balance.
