What happened
Landlord applied for an order to terminate the tenancy and evict Tenant due to the Landlord's requirement of the rental unit for personal residential occupation. The Landlord served a valid N12 Notice with a termination date of January 31, 2021.
The ruling
The tenancy is terminated effective December 4, 2021. The Tenant must vacate the unit by that date. The Tenant must pay the Landlord $8,291.01, representing compensation for use of the unit from February 1, 2021 to November 23, 2021, less the rent deposit and interest. The Tenant must also pay $31.23 per day for use of the unit from November 24, 2021 until the move-out date. If the Tenant does not pay the full amount by December 4, 2021, interest will accrue at 2% annually on the outstanding balance.
