What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to the Landlord's good faith requirement of the rental unit for residential occupation by his own family. The Landlord resides upstairs and the rental unit is a basement apartment.

The ruling

The tenancy is terminated effective October 31, 2022. The Tenant must move out by this date. If the unit is not vacated by October 31, 2022, the Landlord may file the order with the Court Enforcement Office for enforcement. The Tenant is ordered to pay the Landlord $1,000 in compensation for use of the unit from August 1 to September 30, 2022, and $27.95 per day for use of the unit from October 1, 2022 until the move-out date. The Tenant must also pay the Landlord $186 for the cost of filing the application.
