What happened

Landlord applied for an order to terminate the tenancy and evict Tenants due to their failure to meet conditions specified in a previous mediated settlement. The Tenants failed to pay $1,000 towards arrears by November 15, 2020 and failed to pay December 2020 rent by December 1, 2020.

The ruling

The tenancy is terminated effective February 12, 2021. The Tenants must pay the Landlord $19,038.02 (less any amount paid after the application was filed), representing rent arrears up to February 1, 2021 and costs from the previous application, less the rent deposit and interest owed on the deposit. The Tenants must also pay $42.25 per day for compensation for use of the unit starting February 2, 2021 until they move out. If the full amount is not paid by February 12, 2021, the Tenants will owe interest at 2% annually on the outstanding balance.
