What happened
Landlord applied for an order to determine whether the Residential Tenancies Act, 2006 applies to the rental of his property on the Airbnb platform. The tenant had booked the unit for a short-term stay and later proposed a four-month tenancy, which the landlord did not agree to.
The ruling
The Residential Tenancies Act does not apply to the rental of the property, as it was intended to be provided to the travelling or vacationing public for a temporary period. The tenant's attempt to unilaterally change the nature of the agreement was not accepted by the landlord, so the initial temporary rental agreement remained in place.
