What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to persistent late payment of rent. Landlord also claimed compensation for each day Tenant remained in the unit after the termination date.

The ruling

The Landlord's application to evict the Tenant is denied on the condition that commencing April 1, 2021 and for a period of 12 consecutive months (April 2021 to and including March 2022), the Tenant shall pay the monthly rent of $1,425 on or before the first day of each month. If the Tenant fails to make the payments on time, the Landlord may apply under section 78 of the Residential Tenancies Act, 2006 for an order terminating the tenancy and evicting the Tenant. The Tenant shall also pay the Landlord $175 for the cost of filing the application.
