What happened

Tenants alleged that the Landlord substantially interfered with their reasonable enjoyment of the premises and harassed them by demanding they maintain the lawn, and by applying illegal pesticides/herbicides on the property without notice, which destroyed their garden and affected their chicken. The Tenants also alleged the Landlord failed to meet maintenance obligations.

The ruling

The Board found the Landlord seriously interfered with the Tenants' reasonable enjoyment and breached maintenance obligations by using unapproved pesticides/herbicides. The Landlord was ordered to pay the Tenants $500 as a rent abatement and $90 for application fees.
