What happened

Landlords applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears. The tenants had not vacated the rental unit as of the hearing date.

The ruling

The tenancy is terminated effective September 5, 2021. The Tenants must move out of the rental unit on or before September 5, 2021. The Landlords are authorized to offset amounts from the rent deposit owed to the Tenants. If the unit is not vacated by September 5, 2021, the Landlords may file the order with the Court Enforcement Office for enforcement. The Tenants can void the order and continue the tenancy by paying $1,271.85 on or before August 31, 2021, or $2,864.90 on or before September 5, 2021.
