What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenant did not void by paying the arrears. The tenant was not present at the hearing.

The ruling

The tenancy is terminated effective February 5, 2021. The Tenant must pay the Landlord $12,307.62, which includes rent arrears and compensation up to January 25, 2021, less the rent deposit and interest. The Tenant must also pay $57.68 per day for compensation for the use of the unit starting January 26, 2021 until the Tenant moves out. The Tenant can void the order and continue the tenancy by paying $14,451.74 on or before January 31, 2021, or $16,206.24 on or before February 5, 2021.
