What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to non-payment of rent and substantial interference with the landlord's reasonable enjoyment of the property. The Tenant was in possession of the rental unit at the time the application was filed.

The ruling

The L2 application is dismissed. The tenancy is terminated effective October 5, 2020, the date the Tenant vacated the unit. The Tenant is ordered to pay the Landlord $3,452.16, which includes rent arrears and compensation up to the move-out date, less the rent deposit and interest owed on the deposit. The Tenant must also pay the $190 application fee. If the Tenant does not pay the full amount by October 16, 2020, they will owe interest starting October 17, 2020.
