What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the Tenant did not void by paying the arrears. The Tenant was still in possession of the rental unit on the hearing date.

The ruling

The Tenant shall pay the Landlord $9,886, which includes $9,700 in rent arrears and $186 for the application fee. The Tenant shall make monthly payments of $400 from October 2022 to October 2024, and continue to pay the lawful rent as it comes due. If the Tenant fails to make any of the payments, the Landlord may apply to the Board for an order terminating the tenancy and evicting the Tenant.
