What happened

The Landlord applied for an order to terminate the tenancy and evict the Tenants due to their failure to meet a condition specified in a previous order issued by the Board on June 14, 2022. The Tenants failed to pay $300 towards the outstanding arrears by July 15, 2022 and failed to pay the lawful rent for August 2022 by August 1, 2022.

The ruling

The tenancy is terminated effective October 17, 2022. The Tenants must pay the Landlord $11,759.41 (less any amounts paid after the application was filed) for rent arrears and the previous application fee, less the rent deposit and interest owed on the deposit. The Tenants must also pay $60.82 per day for compensation for use of the unit starting September 1, 2022 until they move out. If the full amount is not paid by October 17, 2022, the Tenants will owe interest at 4% annually on the outstanding balance.
