What happened

Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears. The tenant Mary Williams had vacated the rental unit on October 31, 2023, and the other tenant Russ Williams was still in possession.

The ruling

The tenancy is terminated unless the Tenants pay $13,236 by February 19, 2024 to void the order and continue the tenancy. If the Tenants do not pay, they must vacate the unit by February 19, 2024 and pay the Landlord $9,400.66 plus daily compensation of $50.55 per day starting January 17, 2024 until they move out.
