What happened

Landlord applied for an order to terminate the tenancy and evict Tenants due to persistent late payment of rent. The Landlord also claimed compensation for each day the Tenants remained in the unit after the termination date.

The ruling

The Landlord's application for eviction of the Tenant is denied on the condition that: 1) The Tenant shall pay the full monthly rent on or before the first day of each month, commencing May 1, 2021 and for 11 months thereafter up to and including April 1, 2022. 2) If the Tenant fails to comply with the conditions, the Landlord may apply under section 78 of the Residential Tenancies Act, 2006 for an order terminating the tenancy and evicting the Tenant. 3) The Tenants shall also pay to the Landlord $175.00 for the cost of filing the application. 4) If the Tenants do not pay the Landlord the full amount owing on or before May 9, 2021, they will start to owe interest.
