What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the Tenant did not void by paying the arrears. The Tenant had vacated the rental unit prior to the hearing date.

The ruling

The Tenant's motion to set aside the previous eviction order is granted. The Tenant is given a final opportunity to preserve the tenancy by repaying the arrears of $7,030.02 through a structured repayment plan over the next 8 months, in addition to paying the ongoing monthly rent. If the Tenant fails to make any of the scheduled payments, the Landlord may apply to the Board for an order terminating the tenancy and evicting the Tenant.
