What happened

Tenant applied for an order determining that Landlords substantially interfered with the reasonable enjoyment of the rental unit or residential complex by the Tenant or by a member of the Tenant's household.

The ruling

The Tenant's request to review was granted because the Tenant was not reasonably able to participate in the proceedings. The Tenant filed a T2 Application with respect to tenants' rights; however, the Application is based on alleged disrepair. The only remedy the Tenant sought was that the Landlords effect repairs. The Board does not have the jurisdiction to order repairs on a T2 Application. The Tenant was informed of her right to file a T6 Application about disrepair. Order SOT-17569-20 issued on February 12, 2021 is cancelled and the application filed by the Tenant is dismissed.
