What happened
Landlord applied to terminate the tenancy and evict the Tenant due to undue damage, substantial interference, and illegal acts. Tenant applied for an order determining the Landlord harassed, obstructed, coerced, threatened or interfered with the Tenant, substantially interfered with the reasonable enjoyment of the rental unit or residential complex by the Tenant, and withheld or deliberately interfered with the reasonable supply of a vital service, care service, or food that the Landlord is obligated to supply under the tenancy agreement.
The ruling
The Board lacks jurisdiction to hear the applications as the parties were not in a landlord and tenant relationship. The agreement between the parties was more akin to a business venture or loan from a friend, rather than a typical landlord and tenant arrangement.
