What happened

Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears. The tenants had not paid the full rent from January 1, 2020 to November 30, 2020.

The ruling

The tenancy is terminated effective November 16, 2020. The Tenants must move out of the rental unit on or before November 16, 2020. If the Tenants pay $289.00 to the Landlord or the Board in trust on or before November 16, 2020, the eviction order will be void and the Tenants can remain in the unit. If the unit is not vacated by November 16, 2020, the Landlord may file the order with the Court Enforcement Office (Sheriff) for enforcement.
