What happened

Landlord applied for an order to terminate the tenancy and evict Tenant because the Landlord requires possession of the rental unit for the purpose of residential occupation. The application was resolved by order SOL-22980-21 issued on December 21, 2021. The Landlord requested a review of the order and that the order be stayed until the request to review the order is resolved.

The ruling

The request to review order SOL-22980-21 issued on December 21, 2022 is granted. The order cannot be enforced. The interim order issued on January 6, 2022 is cancelled, and replaced with this order. The tenancy is terminated as of September 30, 2021, the date the Landlord discovered the Tenant vacated the rental unit.
