What happened

Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears. The tenants were still in possession of the rental unit on the hearing date.

The ruling

The tenancy will be terminated on October 31, 2022 unless the Tenants pay $4,061.73 by September 30, 2022 or $5,428.95 by October 31, 2022 to void the order. If the Tenants do not pay, they must move out by October 31, 2022 and pay the Landlord $1,462.14 plus daily compensation of $44.94 from August 4, 2022 until the move-out date.
