What happened
Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent and because the landlord has entered into an agreement of purchase and sale of the rental unit and the purchaser requires possession of the rental unit for the purpose of residential occupation.
The ruling
The tenancy is terminated effective June 30, 2017 due to the landlord's agreement to sell the rental unit to a purchaser who requires possession for residential occupation. The tenants are ordered to pay $4,964.30 to the landlord, which includes rent arrears and compensation up to June 6, 2017, plus $50.96 per day for compensation for use of the unit starting June 7, 2017 until the date they move out. The tenants can void the eviction order for non-payment of rent by paying $6,390.00 on or before June 17, 2017, but the tenancy will still be terminated on June 30, 2017 due to the landlord's sale of the unit.
