What happened

Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears. Tenant Nyaboth Reat attended the hearing, but Tenant Peter Akolaween was absent.

The ruling

The tenancy is terminated unless the Tenants pay $25,989.32 by August 31, 2022 or $29,277.33 by September 9, 2022 to void the order. If the Tenants do not pay, they must vacate the unit by September 9, 2022 and pay the Landlord $21,314.17, plus daily compensation of $108.11 from August 19, 2022 until move-out. The Landlord is entitled to file the order with the Sheriff for enforcement if the unit is not vacated.
