What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenant did not void by paying the arrears.

The ruling

The tenancy is terminated effective November 1, 2016. The Tenant must pay the Landlord $2,236.90, which includes rent arrears up to October 7, 2016, NSF cheque charges, and application filing costs, less the rent deposit and interest owed on the deposit. The Tenant must also pay $31.86 per day for use of the unit from October 8, 2016 until move-out. If the Tenant pays $4,120.92 by October 31, 2016 or $5,089.90 by November 1, 2016, the eviction order can be voided and the tenancy can continue.
