What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice of Termination effective August 18, 2020, which the Tenant did not void by paying the arrears. The Tenant was in possession of the rental unit on the application date.

The ruling

The tenancy is terminated effective July 25, 2021. The Tenant must move out by this date. The Landlord is authorized to offset $40.90 per day for compensation for the Tenant's use of the unit starting July 1, 2021 until the Tenant moves out, and $186 for the cost of filing the application, from the amount the Landlord owes the Tenant for the rent deposit and interest. The Tenant can void the order and continue the tenancy by paying $1,430 on or before June 30, 2021, or $2,674 on or before July 25, 2021.
