What happened

The Tenants applied for orders determining that the Landlord collected or retained money illegally and harassed, obstructed, coerced, threatened or interfered with them and substantially interfered with their reasonable enjoyment of the rental unit or residential complex.

The ruling

The Board found that the Residential Tenancies Act, 2006 does not apply to the matters before it, as the Tenants share accommodation with the Landlord, meaning the living accommodation is exempt from the Act. As a result, the Tenants' T2 and T1 applications were dismissed for lack of jurisdiction.
