What happened

Landlord applied for an order to terminate the tenancy and evict Tenants because the Tenants did not meet a condition specified in the order issued by the LTB on September 9, 2022 with respect to application LTB-L-012010-22.

The ruling

The tenancy is terminated and the Tenant must move out of the rental unit on or before February 10, 2023. The Tenant shall pay the Landlord $5,798.08 (less any amounts paid to the Landlord after the application was filed on October 28, 2022), which represents the rent owing up to January 30, 2023 and unpaid NSF charges, less the rent deposit and interest the Landlord owes on the rent deposit. The Tenant shall also pay the Landlord $50.27 per day for compensation for the use of the unit starting January 31, 2023 to the date the Tenant moves out of the unit.
