What happened
Landlord applied to terminate the tenancy and evict Tenants due to non-payment of rent. The Tenants requested a review of the original order, alleging they were not reasonably able to participate in the initial hearing and that there were serious errors in the order. The parties reached an agreement on the disputed tenancy issues, except for the termination date.
The ruling
The Tenants' request to review the original order is granted. The original order is cancelled and replaced. The Landlord shall pay the Tenants $5,000 as an abatement of rent, and the Tenants shall pay the Landlord $34,347, representing rent owing to November 30, 2023, less the rent deposit and the abatement. The tenancy is terminated as of December 31, 2023, and the Tenants must move out by that date. If the unit is not vacated by December 31, 2023, the Landlord may file the order with the Court Enforcement Office for enforcement starting January 1, 2024.
