What happened

Landlord applied for an order to terminate the tenancy and evict Tenants due to their failure to meet a condition specified in a previous order issued by the Board. The Landlord filed the application more than 30 days after the Tenants' alleged breach, which is beyond the time limit set out in the Residential Tenancies Act.

The ruling

The Landlord's application under section 78 of the Act is dismissed. Order CEL-93282-20, issued on March 18, 2021, remains in effect.
