What happened
Landlord applied for an order to terminate the tenancy and evict Tenant due to non-payment of rent. The Landlord served a valid N4 Notice, which the Tenant did not void by paying the arrears. The Tenant contested the rent arrears, claiming the Landlord was receiving payments from Children's Aid Support, but failed to provide evidence.
The ruling
The tenancy is terminated unless the Tenant voids the order by paying the specified amounts. If not voided, the Tenant must move out by March 11, 2023, and pay $6,040.92 plus $42.12 per day from February 17, 2023, until vacating. The Landlord may file for eviction enforcement starting March 12, 2023, if the unit is not vacated.
