What happened

Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears.

The ruling

The order LTB-L-000240-23 issued on February 16, 2023 is cancelled. The previous order EAL-99744-22 issued on October 25, 2022 is also cancelled and replaced with a new order. The Tenant shall pay $2,300 in rent arrears for February 2023 by March 17, 2023. Starting April 1, 2023, the Tenant shall pay the full lawful rent on or before the 1st of every month up to and including March 1, 2024. If the Tenant fails to make any of these payments, the Landlord may apply to the Board to terminate the tenancy and evict the Tenant.
