What happened
Landlord applied for an order to terminate the tenancy and evict Tenant due to non-payment of rent. Landlord served a valid N4 Notice, which Tenant did not void by paying arrears. Tenant raised a preliminary issue about a payment discrepancy, which was addressed. Tenant cited COVID-19 hardships and limited income as reasons for non-payment.
The ruling
The tenancy is terminated unless the Tenant voids the order by paying the specified amounts by the given dates. If not voided, the Tenant must move out by December 31, 2022, and pay $7,851.37 plus daily compensation of $43.17 from September 14, 2022, until move-out. The Landlord may file for eviction enforcement starting January 1, 2023, if the unit is not vacated.
