What happened

Landlord applied for an order to terminate the tenancy and evict Tenants due to persistent late payment of rent. The Landlord had previously obtained an order terminating the tenancy for non-payment of rent, but did not enforce it, wanting to give the Tenants more time to pay. However, the Tenants continued to fail to pay rent on time, so the Landlord filed this application.

The ruling

The tenancy is terminated effective September 18, 2021. The Tenants must move out by that date. If they do not pay the $186 application fee by September 18, 2021, they will owe interest on the outstanding balance starting September 19, 2021 at 2% annually. If the unit is not vacated by September 18, 2021, the Landlord may file the order with the Court Enforcement Office to enforce the eviction.
