What happened
Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenant did not void by paying the arrears.
The ruling
The Landlord's application for eviction of the Tenant is denied on the condition that the Tenant pays $1,000 to the Landlord on or before the 20th of each month from January to June 2022, $2,000 to the Landlord on or before February 28, 2022, and $1,386 to the Landlord on or before July 20, 2022. The Tenant shall also pay the full rent for the months of January to July 2022 on or before the first day of each corresponding month. If the Tenant fails to make any of the required payments, the Landlord may apply for an order terminating the tenancy and evicting the Tenant, and the balance owing shall become payable with interest.
