What happened
Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the Tenant did not void by paying the arrears.
The ruling
The Tenant shall pay to the Landlord $10,137.00 which represents the amount of rent owing to December 31, 2021 plus the application fee as follows: $131.00 (rent) plus $200.00 (arrears) on or before December 7, 2021; $500.00 (arrears) on or before the 20th day of each month for a period of 14 months starting December 20, 2021 to January 20, 2023; $200.00 (arrears) on or before the 1st day of each month for a period of 13 months starting January 1, 2022 to January 1, 2023; and $206.00 (balance of arrears) on or before February 1, 2023. The Tenant shall also pay the Landlord lawful monthly rent on time and in full for a period of 14 months starting January 1, 2022 to February 1, 2023 until the outstanding balance of arrears is paid. If the Tenant fails to make any one of the payments on time and in full, the Landlord may, without notice to the Tenant apply to the Board pursuant to section 78 of the Act for an order terminating the tenancy and evicting the Tenant.
